Successful Case…

ETS was retained by a Personal Injury attorney to serve a summons and complaint upon the defendant in a matter resulting from an auto accident. The attorney reported that he had been receiving little cooperation from the insurance adjuster assigned to the case. When the ETS investigator rang the defendant’s doorbell, the defendant’s wife answered. Upon being served the papers she asked what this was about. The wife was told it was had to do with an accident 18 months prior when her husband had been driving and struck and injured a pedestrian. Her husband who was not visible called out, “Who’s there?” The wife answered, “It’s about when you hit that man.” The husband shouted, “Don’t tell that man nothin!” The wife volunteered, “He’s blind.”

When the investigator asked how it was that a blind man had been driving so recently she responded, “Oh, he was only in the process of going blind then, not fully blind like he is now.” An affidavit detailing what the ETS investigator had heard was supplied to the client. One week later, the attorney telephoned ETS to report that he had just received a check for $90,000.00 from the formerly-uncooperative insurance adjuster.
